These Terms of Service (“Terms”) are a contract between you and TrailerCast (“we,” “us,” or “the Service”). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Who Can Use TrailerCast
You may use TrailerCast if:
- You are at least 16 years old
- You are legally authorized to enter into this agreement
- You will use the Service for business purposes (TrailerCast is a B2B product)
If you are signing up on behalf of a company, you confirm you have authority to bind that company to these Terms.
2. Your Account
You are responsible for:
- Keeping your account credentials secure
- All activity that occurs under your account
- Notifying us immediately if you suspect unauthorized access
You must provide accurate information when signing up. Misrepresenting your identity or affiliation is grounds for account termination.
3. Acceptable Use
You agree not to:
- Upload content you don't have the right to upload (including recordings where participants haven't consented to being recorded, where consent was required)
- Upload content that is illegal, defamatory, harassing, or infringes anyone's rights
- Use the Service to process personal information of EU residents without a proper legal basis
- Attempt to reverse engineer, decompile, or extract source code from the Service
- Circumvent technical limits (quotas, rate limits, access controls)
- Resell, sublicense, or white-label the Service without our written permission
- Use automated tools to scrape, load-test, or mass-upload content
- Upload malware, viruses, or otherwise harmful content
Violating these rules may result in immediate suspension or termination of your account without refund.
4. Content You Upload
You own your content. Nothing in these Terms transfers ownership of your recordings, brand assets, or any content you upload to us.
You grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you. This includes sub-licensing rights to our subprocessors (Anthropic, OpenAI, ElevenLabs, Railway, Vercel, and others listed in our Privacy Policy) strictly to perform their function in the processing pipeline.
We do not use your content to train AI models. We do not share your content with third parties except as described in our Privacy Policy.
5. Subscription & Billing
Free trial
Every new account starts on a free trial of the Starter plan with full feature access. No payment method is required at signup. The trial is limited in both duration and usage; once those limits are reached, the account remains accessible to view existing recordings but new demo processing pauses until a paid subscription is added. To begin a paid plan, add a valid payment method in Settings → Billing and select your tier; billing then proceeds on the standard recurring schedule for that plan. We do not charge any payment method automatically as part of the free trial.
Paid plans
Paid plans (Starter, Pro, Enterprise) are billed in advance on a monthly or annual basis. By upgrading, you authorize us to charge your payment method for the selected plan and any applicable overages, additional seats, or taxes.
- Billing is non-refundable except where required by law. You can cancel anytime; access continues through the end of the paid period
- Pro is per-seat ($70/seat/month; minimum 3 seats). Adding seats prorates to the current billing cycle; removing seats takes effect at the next cycle
- Annual billing locks in 2 months free per seat ($1,000/yr for Starter; $700/seat/yr for Pro)
- Failed payments may result in suspension after a 7-day grace period
- Enterprise plans are governed by a separate written agreement
Price changes
We may change pricing with at least 30 days' notice. Existing paid subscribers will continue at their current rate through the end of their current billing cycle.
6. Recording & Consent
TrailerCast's meeting-bot feature ("Bot") joins video calls on your calendar and records audio + video of the meeting so that we can generate trailers, transcripts, and follow-up content on your behalf. The legal obligations around recording vary by jurisdiction, and both you and we have responsibilities to meeting participants.
Your acknowledgments
Before TrailerCast dispatches a Bot to a meeting on your behalf, you acknowledge in-product that:
- You have authority to record meetings on behalf of your organization and to share those recordings externally as part of your sales workflow.
- You will inform meeting participants that a recording is happening, both through TrailerCast's automatic in-meeting notice and, where appropriate, verbally at the top of the call.
- You understand the recording-consent rules of your selected jurisdiction and will operate within them, including pausing or declining to record when a participant does not consent in regimes that require all-party consent.
Our in-meeting notice
When a Bot joins a meeting, TrailerCast automatically:
- Identifies itself in the participant list using a company-branded display name (e.g. "Acme Notetaker").
- Posts a chat message visible to every participant stating that the meeting is being recorded by TrailerCast on the host's behalf, and including a link to the relevant privacy policy.
- In jurisdictions that require all-party consent (United States two-party-consent states, the European Union, the United Kingdom), the chat notice invites any participant to object so the host can pause the recording.
Jurisdictional variation
Your company admin selects the jurisdiction that applies to your use of the Service. TrailerCast adjusts the Bot's in-meeting notice based on that selection. The selections available are:
- United States, two-party (all-party) consent state: California, Florida, Illinois, Maryland, Massachusetts, Montana, Nevada, New Hampshire, Pennsylvania, Washington, and similar jurisdictions that require every participant to consent to recording.
- United States, one-party consent state: Federal law and the law of most US states, where recording is permitted when at least one participant consents.
- Canada: PIPEDA governs commercial recording; British Columbia additionally applies PIPA.
- European Union / United Kingdom: GDPR / UK-GDPR apply. Recording typically requires a lawful basis, most commonly explicit participant consent.
- Other or not listed: a conservative default in which we treat recording as requiring affirmative consent from every participant.
Jurisdiction selection is a best-effort classification and does not constitute legal advice. You are responsible for confirming your obligations with qualified counsel, especially when recording meetings with participants in multiple jurisdictions. Where rules differ between your jurisdiction and a participant's, the stricter rule generally governs.
Bot dispatch is gated on acknowledgment
TrailerCast will not dispatch a Bot to a meeting on behalf of a user who has not completed the in-product acknowledgment, and will not dispatch a Bot for a company whose admin has not selected a jurisdiction. If the admin changes the jurisdiction, each user must re-acknowledge.
Your obligations to participants
You remain the data controller for meeting recordings dispatched on your behalf. Responsibilities to meeting participants that remain with you include (but are not limited to):
- Obtaining any consents required by the jurisdiction you operate in and the jurisdictions of the participants on your call.
- Responding to participant data-subject requests (access, correction, deletion, portability) relating to the recorded content.
- Maintaining your own privacy policy that accurately describes how you use recordings and follow-up communications generated by TrailerCast.

7. Cancellation & Termination
You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You can delete your account at any time, which will permanently remove your content within 30 days.
We may suspend or terminate your account if:
- You materially violate these Terms
- You fail to pay after the grace period
- We are required to by law or court order
- Continued service would create legal or security risk to us or other customers
Where practical, we'll give you advance notice and an opportunity to correct the issue before terminating.
8. Service Availability
We work hard to keep TrailerCast available 24/7, but we don't guarantee uninterrupted service. Planned maintenance will be communicated in advance. Unplanned outages will be posted on our status channel and communicated to affected customers.
Enterprise plans can include a formal SLA with credits for qualifying outages. Free, Starter, and Pro plans are provided on a best-effort basis without an SLA.
9. Intellectual Property
The TrailerCast service, software, brand, and all associated intellectual property belong to us. These Terms do not grant you any rights to our trademarks, logos, or brand assets.
Any feedback, suggestions, or ideas you share with us about the Service may be used by us without obligation or compensation to you.
10. AI-Generated Content
TrailerCast uses AI to detect demo moments, generate narration, write follow-up emails, and compose trailers. You acknowledge that:
- AI output may contain inaccuracies and should be reviewed before being shared externally
- You are responsible for verifying and editing AI-generated content before using it
- You retain all rights to AI-generated content created from your inputs, to the extent allowable by applicable law
11. Disclaimer of Warranties
The Service is provided “as is” without warranties of any kind, whether express or implied. We do not warrant that the Service will be error-free, secure, or continuously available, or that AI-generated output will be accurate, complete, or fit for any particular purpose.
12. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claim arising from these Terms or your use of the Service is limited to the greater of:
- The amount you paid us in the 12 months before the claim arose
- USD $100
We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we were advised of the possibility.
13. Indemnification
You agree to defend and indemnify us against claims arising from your use of the Service in violation of these Terms, your content, or your violation of third-party rights (including intellectual property and privacy rights of anyone recorded in content you upload).
14. Changes to the Service
We may add, remove, or modify features. Where changes materially reduce functionality for paid plans, we'll notify you in advance and offer a prorated refund if you choose to cancel as a result.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email and in-app notice at least 30 days before taking effect. Continued use of the Service after the effective date means you accept the updated Terms.
16. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Disputes will be resolved in the courts located in Toronto, Ontario, unless applicable consumer protection law entitles you to a different forum.
17. Miscellaneous
- Entire agreement: These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service
- Severability: If any provision is unenforceable, the rest remain in effect
- No waiver: Our failure to enforce a provision is not a waiver of our right to enforce it later
- Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets
- Notices: We may send you notices by email to the address on your account. You can send notices to us at support@trailercast.io
